Terms of Service

Please read these carefully. Section 4 (payments, fees and refunds) and sections 9–11 (disclaimers and liability) are the ones people ask about.

1. Acceptance of these Terms

These Terms of Service (“Terms”) are a binding agreement between you and FastInspector, Inc. ("FastInspector", "we", "our", or "us"), governing your use of the FastInspector website, apps and API (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you use the Service on behalf of an inspection company or a brokerage, you confirm you are authorised to bind it, and “you” includes it.

You must be at least 18 and able to enter a contract to use the Service.


2. What the Service is — and is not

FastInspector is a marketplace. Real-estate agents (“Agents”) book property inspections; independent inspection companies (“Companies”) accept those bookings and dispatch their inspectors (“Inspectors”) to carry them out and deliver a report. We provide the platform: matching, scheduling, messaging, payment collection and payout, report delivery and buyer sharing.

We do not perform inspections. Companies and Inspectors are independent businesses, not our employees or agents. The inspection itself is governed by the pre-inspection agreement the Company publishes and the Agent signs for each appointment; that agreement is between the Agent and the Company. We record the signature (name, time, agreement version) so both sides have the same copy, and we do not add to or alter its terms.

A “verified” badge means we reviewed the credential documents a Company submitted and they appeared valid on the date of review. It is not a guarantee of the Company’s competence, insurance, or the accuracy of any report.


3. Accounts

  • You sign up as one of three roles. Agents book. Company owners manage a Company — its profile, service areas, pricing, credentials, payout account and Inspectors. Inspectors are added by a Company and act for it.
  • Keep your sign-in credentials secure and tell us at once about unauthorised use. You are responsible for what happens under your account.
  • Information you provide — property details, Company details, credentials, payout details — must be accurate and kept current. Submitting someone else’s licence or a false credential is grounds for immediate termination.
  • We may block a Company (and with it, its Inspectors) or suspend an account while we investigate a complaint, a chargeback, a credential problem or a breach of these Terms.

4. Bookings, payments, fees and refunds

Booking and payment

An Agent books one or more inspection types for a property and pays the Company’s listed price at booking, through Stripe or Flutterwave depending on the Company’s payout currency. The Company then accepts or declines the request. Card details are handled by the payment provider; we never see them.

Platform fee

FastInspector retains a platform fee from each paid inspection, fixed at the moment of charge and never changed afterwards: 20% on the first paid job between a given Agent and Company (we introduced them), and 10% on every later job between that same pair (they already know each other). Card processing and payout-transfer fees come out of our share, not the Company’s. Rates for a specific Company may be adjusted by written agreement; the rate applied is shown on each appointment before the Company accepts.

Money is held until the report is delivered

We hold the Agent’s payment and release it to the Company only after the Inspector delivers the report, plus a short dispute window (shown in the app) during which the Agent can raise a problem with the report. Companies see this timing before accepting a request and when connecting a payout account.

If the report is not delivered

Inspectors must deliver the report within 48 hours of completing the inspection. If no report arrives, all three parties are warned, and on a deadline computed from the report’s due date and the Agent’s contingency deadline (never earlier than the provider’s settlement period), the payment is refunded automatically to the Agent. The same applies to an accepted inspection that never happens. At any point before that, the Agent may choose to release the payment anyway — for a report that is late for a good reason — and that choice is final.

Cancellation

An Agent may cancel an appointment any time before the Inspector marks it completed. Cancelling does not by itself refund the payment. Contact support@fastinspector.com with the appointment; refunds for cancellations are issued at our discretion, considering how late the cancellation was and whether the Company incurred cost, and always to the original payment method. If a Company declines a request, the Agent’s payment stays held and the Agent can re-route the booking to another Company from the app; an Agent who would rather not should contact support for a refund. An accepted inspection that never takes place is refunded automatically on the deadline described above.

Refunds, chargebacks and disputes

Refunds are made to the original payment method and may take several days to appear. If a card payment is disputed with the card issuer, we freeze the related payout while the dispute runs and may recover a payout already made to the Company if the dispute is lost. Opening a card dispute for a report that was delivered as agreed is a breach of these Terms.

Payouts

Companies are paid through the payout account they connect (Stripe) or provide (Flutterwave). Payouts are made in the Company’s payout currency; a Company that changes currency must re-price its offerings before new bookings are accepted. Companies are responsible for their own taxes on amounts received.


5. Inspections, reports and repair requests

  • Companies and Inspectors must be licensed and insured as their jurisdiction requires, attend accepted appointments, keep the Agent informed (en route, completed) and deliver a complete, honest report within the 48-hour window.
  • Agents must provide accurate property details and access, and must sign the Company’s pre-inspection agreement before an Inspector is assigned.
  • A delivered report is a record: it cannot be edited after delivery. Anything a Company needs to correct is issued separately and does not replace it.
  • The Agent who commissioned a report, and the buyer they share it with, may use it for the transaction it was ordered for. Reports and their photos remain the work of the Company that produced them; you may not republish, resell or strip attribution from them.
  • Buyer share links give whoever holds the link read-only access to an appointment’s status and report until the link expires or the Agent revokes it. Links are rate-limited and must not be posted publicly.
  • Repair requests an Agent builds from a report are the Agent’s document; FastInspector is not a party to any negotiation that follows.
  • Ratings must reflect a real appointment. We may remove ratings that are abusive, off-topic or evidently not from the Agent on that booking.

6. Acceptable use

You agree not to:

  • Book, accept or attend an inspection you do not intend to carry through.
  • Use the Service to arrange an inspection and then pay for it outside the Service.
  • Misrepresent your identity, role, licence, insurance or credentials.
  • Upload content that is unlawful, infringing, defamatory or that you have no right to.
  • Harass any Agent, Company, Inspector, buyer or member of our staff.
  • Scrape the Service, probe or interfere with its security, or access data that is not yours (including another user’s bookings or a share link you were not given).
  • Reverse-engineer the apps or use the API other than through our clients.

7. Your content and our intellectual property

You keep ownership of what you submit — property details, reports, photos, messages, reviews. You grant FastInspector a worldwide, non-exclusive, royalty-free licence to host, store, display and transmit that content as needed to operate the Service, including showing it to the other parties on the appointment and to buyers you share with. That licence ends when the content is deleted, except for records we must keep (section 4 of the Privacy Policy on retention).

The Service itself — software, design, trademarks, and the FastInspector name — is ours or our licensors’ and is protected by intellectual-property law. These Terms grant you a limited, revocable, non-transferable right to use it; nothing else.


8. Third-party services

The Service depends on providers we do not control — Clerk for sign-in, Stripe and Flutterwave for payments, Cloudinary for media, OpenStreetMap for maps, Apple and Google for push. Their terms apply to your use of their features. Payment providers may require identity verification from Companies before paying out; we cannot override that.


9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY INSPECTION WILL BE PERFORMED, THAT ANY REPORT IS ACCURATE OR COMPLETE, THAT A PROPERTY IS FREE OF DEFECTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. An inspection report is the professional opinion of the Company that produced it; decisions about a property are yours and your buyer’s.


10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FASTINSPECTOR AND ITS OFFICERS, EMPLOYEES AND SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DEALS, OR PROPERTY DEFECTS THAT AN INSPECTION DID OR DID NOT FIND, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY INSPECTION ARRANGED THROUGH IT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE PLATFORM FEES WE RETAINED ON YOUR TRANSACTIONS IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED US DOLLARS (US$100).

Some jurisdictions do not allow these limits; where that is the case they apply to the extent permitted, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or any liability that cannot be limited by law. Your statutory consumer rights are unaffected.


11. Indemnification

You will defend and indemnify FastInspector against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, your inspection work or your use of a report, or your violation of any law or third-party right. This includes, for Companies and Inspectors, claims by Agents or buyers about the conduct or findings of an inspection.


12. Termination

You may close your account at any time; see account deletion. We may suspend or terminate your access for breach of these Terms, for fraud or a pattern of disputes, for credential problems, or where the law requires. On termination, appointments already paid for run to completion or refund under section 4; records we must keep are retained per the Privacy Policy; sections 7, 9, 10, 11, 13 and 15 survive.


13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. Nothing in this section limits rights you have under the mandatory consumer-protection laws of your country of residence.

Before starting any formal proceeding, write to legal@fastinspector.com and we will try to resolve the matter with you within 30 days. Disputes that are not resolved are subject to the exclusive jurisdiction of the courts of the Commonwealth of Virginia, United States, except that you may bring a claim in a small-claims court where you live, and either party may seek injunctive relief in any competent court. Disputes between an Agent and a Company about an inspection are between them; we may provide records, and we are not a party.


14. Changes to these Terms

We may update these Terms. For material changes we will give notice in the app or by email at least 14 days before they take effect, and the effective date above will change. Continued use after that date is acceptance. Fee changes never apply to a payment already charged.


15. Miscellaneous

  • These Terms, the Privacy Policy and any written rate agreement with a Company are the entire agreement between you and us about the Service.
  • If any part is unenforceable, the rest stands.
  • Our not enforcing a term is not a waiver of it.
  • You may not assign these Terms; we may assign them to a successor of the business.
  • Notices to you go to the email on your account; notices to us go to legal@fastinspector.com.
